In our experience we find that many of the Newfoundland & Labrador workers who have subsequently become ill did not work only in N&L. This raises the potential of application to other Workers’ Compensation Boards. Additionally, if your work, or some of it, predates 1949, or you were a civilian employee at one of the US Air bases please contact us to discuss, as your option to apply for Workers’ Compensation may not exist.

If you were exposed to asbestos by working with it in Newfoundland & Labrador you have an option to choose either to claim from the Workers’ Compensation board or by retaining a lawyer to put forward compensation claims to the asbestos trusts. You cannot do both but the option lies with the worker. An excerpt of the legislation that covers this issue is set out below:

Workplace Health, Safety and Compensation Act RSNL1990 Chapter W-11

Where action allowed
45. (1) Where a worker sustains an injury in the course of his or her employment in circumstances which entitle him or her or his or her dependents to an action

1. against some person other than an employer or worker;
2. against an employer or against a worker of that employer where the injury occurred otherwise than in the conduct of the operations usual in or incidental to the industry carried on by the employer; or
3. where section 44.1 applies,

the worker or his or her dependents, where they are entitled to compensation, may claim compensation or may bring an action.
